Terms of Service

These Terms of Service ("Terms") govern your use of the NumGeek mobile application available on Google Play under the name NumGeek: SumFind Chronicles (the "App") and any related services we provide (together, the "Service").

The Service is operated by Dominik Ornat, sole proprietor doing business as Numgeek, with place of business in Poland (hereinafter "NumGeek", "we", "us", or "our").

By downloading, installing, or using the App, you agree to be bound by these Terms and by our Privacy Policy. If you do not agree, please do not use the App.

1. Eligibility and account

You must be at least 13 years old (or 16 in jurisdictions where that is the applicable digital age of consent) to create an account and use the App. By using the App, you confirm that you meet this requirement.

To access the full functionality of the Service (cloud progress, leaderboard, in-app purchases) you need to create an account using email and password or by signing in with your Google account. You are responsible for keeping your credentials confidential and for all activity that occurs on your account.

2. Licence to use the App

Subject to your compliance with these Terms, we grant you a personal, non-exclusive, non-transferable, revocable licence to download and use the App on devices you own or control, solely for your private, non-commercial enjoyment.

We reserve the right to investigate, suspend, or terminate accounts that violate these rules, and to refuse, withhold, or revoke entitlements obtained through fraud or abuse.

4. In-app purchases

The App is free to download. It offers optional in-app purchases ("IAPs"), for example "Remove Ads", "Unlock All Levels", and the "Premium Bundle". All IAPs are processed by Google Play Billing; we do not receive or store your payment card details.

Prices and product availability are displayed in the App at the time of purchase, including all applicable taxes (where required). The currency and price shown to you are determined by Google Play based on your billing region.

IAPs grant you a personal, non-transferable entitlement (such as the removal of advertisements or unlocking of game content) tied to your NumGeek account. Entitlements are restored automatically when you sign in to your account on another device, or via the "Restore Purchases" button in the Settings screen.

Refunds for IAPs are handled by Google Play in accordance with the Google Play refund policy. To request a refund, please use Google Play directly (Google Play refunds). We are happy to assist if Google Play directs you back to the developer — please contact aha@numgeek.com.

5. Right of withdrawal (EU consumers)

Important — please read before purchasing. In-app purchases are digital content that is delivered to you immediately upon purchase (entitlements are activated as soon as Google Play confirms the transaction).

Under Article 16(m) of Directive 2011/83/EU on consumer rights (and the corresponding provisions of the Polish Consumer Rights Act of 30 May 2014), the right of withdrawal within 14 days does not apply to contracts for the supply of digital content not delivered on a tangible medium if performance has begun with the consumer's prior express consent and acknowledgement that the right of withdrawal will thereby be lost.

This does not affect your statutory rights regarding faulty digital content (Articles 43h–43q of the Polish Consumer Rights Act, implementing Directive (EU) 2019/770). If a purchased entitlement does not work as described, please contact aha@numgeek.com and we will resolve it promptly.

6. Advertisements

Unless you have purchased the "Remove Ads" or "Premium Bundle" entitlement, the App displays advertisements served by Google AdMob, including a small banner during gameplay and an occasional full-screen interstitial between levels.

Advertisements are provided by Google and its ad partners; we do not control, endorse, or take responsibility for the content of third-party ads. For users in the European Economic Area, the United Kingdom, and Switzerland, the App displays a Google-certified consent message (Google User Messaging Platform) on first launch, which lets you choose between personalised and non-personalised advertising. You can change your choice at any time from the in-app Settings screen.

7. Username and leaderboard

The App offers a public leaderboard that displays your chosen username and your total stars earned. By participating, you agree that this information is publicly visible to other players. You are responsible for choosing a username that you are comfortable being shown publicly and that does not contain personal data, offensive content, or third-party trademarks.

We may rename, hide, or remove leaderboard entries that violate these Terms or that we reasonably believe were obtained through cheating.

8. Intellectual property

The App, including its source code, graphics, audio, characters, trademarks, logos, level design, and the "NumGeek" and "SumFind Chronicles" brand names, is owned by Dominik Ornat (Numgeek) or licensed to us, and is protected by Polish, EU, and international copyright and trademark law.

Nothing in these Terms transfers any ownership of intellectual property to you. All rights not expressly granted are reserved.

9. Service availability and changes

We work to keep the App available and reliable, but we cannot guarantee uninterrupted, error-free, or uninterrupted operation. We may, at our discretion and without prior notice:

Where reasonably possible, we will notify users in advance of material changes that affect previously purchased entitlements.

10. Disclaimer of warranties

Except for the statutory rights granted to consumers under Polish and EU law (which are not excluded by these Terms), the App and the Service are provided "as is" and "as available", without warranties of any kind, whether express or implied, including warranties of merchantability, fitness for a particular purpose, or non-infringement.

11. Limitation of liability

To the maximum extent permitted by applicable law, NumGeek will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits, revenue, data, or goodwill, arising out of or related to your use of the Service.

Our aggregate liability to you for any claim arising out of or related to these Terms or the Service is limited to the greater of (a) the total amount you paid us through in-app purchases in the 12 months preceding the event giving rise to the claim, or (b) ten euros (EUR 10).

Nothing in these Terms limits or excludes liability that cannot be limited or excluded under applicable law (in particular, liability for death or personal injury caused by negligence, for fraud, or under mandatory consumer protection law).

12. Termination

You may stop using the App and delete your account at any time from the Settings → Account → "Delete account" option. Deletion is permanent and removes your account data within 30 days, except where retention is required by law (see our Privacy Policy).

We may suspend or terminate your access to the Service if you breach these Terms (in particular Section 3 — acceptable use), if your use creates a legal or security risk, or if we are required to do so by law.

13. Governing law and disputes

These Terms are governed by the laws of the Republic of Poland. The application of the United Nations Convention on Contracts for the International Sale of Goods is excluded.

Where you are a consumer with habitual residence in the European Union, this choice of law does not deprive you of the protection afforded by the mandatory provisions of the law of your country of residence (Article 6 of Regulation (EC) No 593/2008 — Rome I).

Any dispute that we cannot resolve amicably will be subject to the jurisdiction of the courts having competence according to applicable law. Consumers in the European Union may also use the European Commission's Online Dispute Resolution platform at ec.europa.eu/consumers/odr, or contact their national consumer protection authority.

14. Changes to these Terms

We may update these Terms from time to time. The "Last updated" date at the top of this page indicates when the latest revision was published. Material changes will be communicated through the App or by email to the address associated with your account at least 14 days before they take effect, where practicable. Your continued use of the App after the changes take effect constitutes your acceptance of the revised Terms.
